Every personal injury claim is different and there are no guarantees. Below are rough answers to some questions we hear frequently about personal injury. Further below is a specific FAQ on No-Fault in New York.
Personal Injury FAQ
Q: How much do lawyers charge?
A: For most personal injury claims, there is no fee unless you collect. Most lawyers in New York charge a one-third contingency fee. When the claim is resolved, the lawyer gets reimbursed for expenses out of the award. Next the lawyer takes the one-third fee. For example, if a claim settles for $35,000, and the lawyer has $2000 in expenses, the fee is $11,000 (1/3 of $33,000). The client would get $22,000.
Q: Does the lawyer always pay the expenses up front?
A: Usually, but not always. There are two major situations where we don’t. First, some personal injury claims are not very strong, but we might still be willing to work on a contingency fee basis. In such claims, we will tell the client that they will have to pay the expenses. The other situation is when there is a good offer and the client refuses to accept it against our advice. In these lawsuits we require the client to cover all future expenses.
Q: What are typical expenses in a personal injury lawsuit?
A: In New York personal injury lawsuits, filing fees usually total less than $500. Deposition transcripts also usually total less than $500. The biggest expense is when a lawsuit goes to trial and we have to pay doctors and other experts to testify. We have paid anywhere from $300 to $7500 for a doctor’s testimony, and some doctors charge as much as $5000. Other expenses include process servers, investigations, medical records, and meals. In some cases you may need other experts. In one big case we spent about $10K on an accident reconstructionist. The other side spent about $40K on theirs.
Q: What is the process?
A: First most lawyers negotiate with the insurance company. If negotiations are unproductive, the lawyer files a lawsuit. For a few months the lawyers exchange paperwork with the insurance company attorneys. Next come depositions, where they question the plaintiff client and the plaintiff lawyer questions theirs. Then the insurance company might have the plaintiff examined by their doctor in what’s known as an IME – Independent Medical Examination. Plaintiff lawyers prefer to call this a Defense Medical Examination. Last is trial. A lawsuit might settle at any point along the way, even while the jury is deliberating.
After a trial the losing side can appeal. Sometimes even the winner can appeal. Cases sometimes settle during the appeal process.
When you are hurt in an automobile accident in New York State, No-Fault insurance can help with many of your costs. The following frequently asked questions (FAQ) will help you to understand when and how No-Fault pays, what it pays for, and what you have to do.
Q: Am I eligible for No-Fault benefits?
A: You are eligible to receive No-Fault benefits in New York State if:
1. You are injured in an automobile accident;
2. You are a pedestrian struck by a car or motorcycle;
3. You are hurt during the use, operation or maintenance of a motor vehicle unless you are injured in the course of the business of repairing or maintaining a vehicle.
*** Motorcycle drivers and their passengers are not eligible for No-Fault benefits.
Q: What do I do first?
A: Submit your medical expenses and lost wages. Forms for No-Fault and New York State Disability income benefits are provided by the No-Fault carrier (the insurance company that insured the car you were in or struck by at the time of the accident). To begin the process, you have to submit paperwork to that carrier. Failure to file in a timely manner may result in a denial of benefits. We recommend submitting this information as quickly as possible, and we can help with the process.
Q: What information will I need to submit?
A: You will be asked to list all medical providers and facilities that are treating you. The No-Fault carrier will send forms to your doctors. Most will submit their bills directly to the carrier. You should also list your employer(s), and any other related expenses.
Q: What if I go to a new doctor for treatment?
A: Give the new doctor the name and address of the No-Fault carrier so that they too can submit their bills for payment by the carrier. Once your application has been filed, the No-Fault carrier assumes responsibility for the medical bills resulting from the accident.
You must also list your employer on the application for No-Fault benefits so that any lost wages you incur as a result of the accident can be recovered.
Q: What if my child is hurt in an accident?
A: In New York State, if a minor (someone under the age of eighteen) receives medical treatment as a result of an automobile accident, the parent or guardian is legally responsible for those medical bills. Thus, the parent or guardian must forward the minor’s medical bills to the No-Fault insurance carrier, just as they would their own. Again, the No-Fault application must be timely filed, or benefits may be denied.
Q: Besides medical bills, what other costs can I recover through No-Fault?
A: In New York State, you may be reimbursed by the No-Fault carrier for the cost of lost wages, prescriptions, travel expenses for medical treatment, and household help while you are recovering from your injuries – including costs of child care while you visit medical providers. To get reimbursed for these expenses, you must submit them to No-Fault. We recommend submitting expenses immediately.

Cushing syndrome is one of the most common endocrine diseases that dogs can suffer. The common thing is that it appears in animals older than six years and among small dog breeds (such as Yorkshire, Maltese or Schnauzer bichon). It is a chronic disease that can not be prevented, but with the right treatment, your pet can enjoy a good quality of life. Below we tell you what it consists of and what are its possible treatments.
Origin of Cushing syndrome in dogs
This condition causes alterations in the metabolic system and occurs when the body begins to produce large amounts of the hormone cortisol (which is responsible for responding to stress). Excess of this hormone can cause health problems to your pet, such as damage to your vital organs or reduction of energy and strength.
These are the main causes of Cushing syndrome:
• Pituitary-dependent tumors
These tumors are located in the pituitary gland of the brain. It causes increased production of adrenocortical hormone-trope (ACTH) and over-stimulation. This leads to increased production of cortisol in the adrenal glands.
• Adrenal Tumors
These are tumors located in the adrenal glands. This abnormality affects the cortex of one or both glands (located in the upper extremities of the kidneys).
They are medicines used to combat or control allergy problems and immunosuppressive diseases. Their overuse can fill the body with cortisol while slowing the activity of the adrenal glands and reducing them in size.
• Racial predisposition
There are several breeds of dogs that tend to have pituitary tumors (poodle, tackle, Boston terrier, bobtail, German shepherd, dwarf poodle… ). On the other hand, the glucocorticoid’s effect especially races like the shepherds of the Pyrenees, the farmers, the boxers and the poodles, making them more susceptible to get this syndrome.
This disease can not be predicted or predicted, and you can not avoid it (except to control the doses of glucocorticoid’s), but detect it in time itself. The following are the most common symptoms for detection. If you detect any of them in your pet, we advise that you go to the veterinarian to diagnose it and, if necessary, start treating it as soon as possible
• Lack of hair on the body, especially on the sides and tail.
• Polyura increased urine.

But this is quite complicated since you have to find the exact proportion of hormone-regulating drugs. The good thing is that once this ratio is found your dog will be able to have a normal life again.
In addition to pharmacological treatment (which would be for life), there is also the possibility of surgery if the syndrome is caused by adrenal and pituitary-dependent tumors. The operation is to remove the tumor, but it is more risky and complex than the pharmacological treatment.

Is it really possible to lose fat and build muscle at the same time? I wanted to pack on some rock solid muscle but I didn’t want to start getting fat at the same time. I mean really, a lot of us skinny guys might hate being skinny. We hate being called anything that even implies that we’re thin. We hate being the smallest guy in our group of friends and we hate wearing those baggy clothes that hide our bones. But we don’t want to get fat with a pot belly either, do we?
I know all this because I was a skinny guy not too long ago, and in the process of putting on muscle I didn’t want to end up getting fat. Fortunately, I found the right way to lose fat and build muscle at the same time. well maybe not at the SAME time. AND I had chubby friends who wanted to slim down to a muscular physique and they too can relate to this article.
Now here’s simple science for you. If you gain muscle your bodies basal metabolism goes up. If your metabolism increases you burn more fat. So essentially by the simple act of gaining muscle, you can burn fat.
However, the problem lies in the diet. You see to burn fat your diet needs to have a shortage of calories, while to gain muscle you need a surplus. This is the simplest factor involved and the only one I’m going to mention right now. That and the fact that there isn’t a “lose fat and build muscle at the same time” meal plan.
So when you’re on a hard-core muscle-building routine, you will be consuming so many calories that your body will put on fat. And sometimes it puts on fat faster than your muscle burns it. So while you’re gaining muscle, you are also gaining a little bit of fat.
To lose fat and build muscle at the same time, you will have to cycle between periods of caloric surplus and caloric deficit. The problem here is that while you’re able to lose fat and build muscle at the same time you are slowing each individual process down.
Here’s the conundrum simplified.
– On the one hand, to lose fat and build muscle at the same time, you have to cycle between caloric surplus and deficit and so it will take a longer time for you to reach your goals of getting a buff, ripped body.
– On the other hand, while gaining muscle at full speed, your caloric intake also results in you gaining a certain amount of fat.
These are 2 undeniable truths. So here’s where you have to choose. You can either decide to reach your goals slower and take the lose fat and build muscle at the same time path. OR you can go crazy building muscle first, and then change your diet so you lose the fat you’ve gained after you reach your muscle gain goals.
Personally, I’m not the “lose fat and build muscle at the same time” kind of guy. Not if it’s going to take ages anyway. So, I went full steam ahead putting on muscle, and once I had gained 25+ pounds of muscle, I cut back on my caloric intake started doing a fat loss training routine, and got to my buff and ripped state.
PS: I still have some more work to do before I get my body to where I want it, but I know it can be done and more importantly I know how to do it.
My opinion is that it is unnecessary to lose fat and build muscle at the same time. Build muscle as fast as you can. That tiny bit of fat that you will have for a while will be a tiny price to pay when sooner than you know it you start getting complimented by all your friends, family and those girls about how much more buff and ripped you have gotten.

Before cheerleading became an integral part of professional sports as a way to help fans cheer on their team, it had its beginnings at the collegiate level. Through many decades it has evolved not only as a competitive sport in its own right, but has served as an emissary to bring attention to charitable causes and offer support in a variety of ways.
Cheerleading had its origins at the University of Minnesota. The very first cheerleader was a University of Minnesota student named Johnny Campbell. During a football game he stirred up the crowd by cheering, “Rah, Rah, Rah! Ski-u-mah, Hoo-Rah! Hoo-Rah! Varsity! Varsity! Varsity, Minn-e-so-Tah!” The date was November 2, 1898. The university later put together a cheering squad made up of six male students who continued using Campbell’s original cheer. Although cheerleaders were originally all-male squads, by 1923 females were being incorporated and eventually made up the majority of participants. Cheerleading soon began including routines such as tumbling, gymnastics, and the use of megaphones during football games.
In 1948, a former cheerleader at Southern Methodist University named, Lawrence Herkimer, formed the National Cheerleaders Association. It was created to hold cheerleading clinics, and by the 1960’s, college cheerleaders hosted workshops across the nation teaching the fundamentals of cheering to teenage girls in High School. In 1965, Fred Gastoff, invented the vinyl pom-pon which was introduced in competitions hosted by the International Cheerleading Foundation. Today it is known as the World Cheerleading Association. Organized cheerleading competitions sprouted everywhere until 1978 when CBS broadcast the first Collegiate Cheerleading Championships, bringing wider attention to the sport. Although cheerleading rarely got much attention during the 1960’s, and cheerleaders were not exactly a reason to watch football, what did begin to emerge were organized professional cheerleading teams.
Before they became the famed Dallas Cowboys Cheerleaders, the Dallas Cowboys had a cheer squad made up of male-female high school students called CowBelles & Beaux. During the 1970 football season, Cowboys manager, Tex Schramm, decided to completely overhaul the cheerleaders, making them an all-female squad over the age of 18, redesigning the uniforms, creating new dance style cheer routines, and forming an overall sexier look in hopes of boosting attendance. The women not only had to be attractive and have athletic abilities when they auditioned, they also needed to possess raw talent as performers. The Dallas Cowboys Cheerleaders made their first appearance on the sidelines during the 1972-1973 NFL seasons. Since then, they have appeared on many television shows, toured throughout the U.S. and overseas, and have made regular appearances in the USO tours to support our troops.
Modern cheerleading has changed dramatically from its original function of spurring an audience to show their support for the team. It has become a sport in itself, competing outside of sporting events as well. Cheerleaders are found in most American middle schools, high schools, and colleges with organized squads made up of students. Cheerleading scholarships are even offered by colleges that compete at cheerleading competitions.
Cheerleading squads began to emerge in the 1980’s that didn’t have an association with a school or sports league. Their main objective was solely competition. Divisions and teams were created and sponsored by many different organizations and companies. The competitions are judged based on the difficulty and execution of the routines that include jumps, stunts, tumbling, creativity, showmanship, synchronization, and overall routine performance. These all-star team competitions are broadcast to global audiences that have led to thousands of cheerleading participants from countries worldwide.
Professional cheerleading has taken cheerleaders beyond the sphere of cheering at games. It has broadened their horizons doing charity work and philanthropy, television performances, advertising, modeling, and motivational speaking. Cheerleading has come a long way.
